13 Jul (COFFEE COUNTY, TENN) – Three years after attorney Ralph Bard MD filed a lawsuit against the Semmelweis Society International (SSI) Board of Directors, Coffee County Circuit Court Judge Vanessa Jackson has dismissed the complaint.  Bard filed the lawsuit in 2008 against SSI Board Members found Bard and his associates guilty of misconduct and revoked his membership, along with those of Lokesh Vuyyuru MD, Henry Butler MD, Blake Moore MD and George Holmes PhD.

Their lawsuit was destined to fail from the beginning.

Having been fined for filing frivolous lawsuits in the past, doctors Vuyyuruand James Murtagh MD aided the plaintiffs by taking on supporting roles: While Vuyyuru posted a series of fake SSI websites and documents, Murtagh used his experience as a perjurer to file additional worthless documents. 

For his part, Bard filed his own “document dump” on December 1^st, 2008 and waited until December 3^rd to mail it, ensuring its late arrival onDecember 6^th.  Although the SSI Board had until January 5^th (30 days) to respond, Bard falsely claimed that he filed his complaint on November 28and that the Board failed to respond in a timely manner.  He then used his false claim to ask for a judgment against the Board – the first of many motions the court denied.

Bard’s meritless lawsuit is the preferred method used by corrupt organizations to retaliate against honest individuals.  The book Crime & Corruption in Organizations (Burke, 2011) describes how drug giant Bristol-Myers Squibb (BMS) retaliated after the Canadian Coordinating Office for Healthcare Technology Assessment (CCOHTA) reported that all statins were the same.  BMS sued to prevent the release of the report and eventually lost; but the lawsuit kept the report from consumers for more than a year and eventually cost CCOHTA 13 percent of its annual budget.  For CCOHTA and the SSI Board, it would have been less expensive to acquiesce to the corruption.

Surprisingly for the Plaintiffs, SSI’s Board didn’t surrender.

Silenced Voices on AIDS

The following is a list of just a few of the senior scientists who have long maintained that AIDS cannot be caused by HIV, or by HIV alone. or who believe that suppression of this debate about the cause of AIDS is wrong.  Many hold that AIDS is caused by long-term exposure to certain toxins as well as by malnutrition or other non-viral factors.

If you have not heard of their work, this is not a surprise. Ten years ago I had not heard of them either - yet I then regarded myself as a well-informed journalist.  It seems their work has mostly been ignored, or presumed to be that of cranks. For example, you will find nothing indicating the depth of this scientific dissent on the BBC webpages on AIDS. Do these scientists deserve this? Look at what they have written, the positions they hold, and judge. Many of their papers are freely available on websites. This list is in no particular order.

WHAT HIV DRUGS DO

The previous post (OFFICIAL GUIDELINES FOR HIV TREATMENT, 14 December 2007) offered some extracts from the text of the official Guidelines for treating “HIV-1 infected” people, even when they don’t feel ill and are not visibly ill. The Guidelines also have detailed Tables listing the frequent and serious “side” effects of antiretroviral drugs.

The scare quotes are around “side” to emphasize how evasive a euphemism this is. Molecules, chemicals, drugs can’t choose to do only what we want them to do. Any foreign substance disturbs our physiology, which is an intricate system of balances and feedbacks where any one change is likely to induce others as well. The more powerful a molecule, the more likely it is to disrupt our metabolism in multiple ways. Antiretroviral drugs are extremely powerful molecules that can kill cells and block receptors and incapacitate enzymes. As in cancer chemotherapy, antiretroviral treatment kills or disables innocent as well as guilty cells.

All examples in the following are taken from the 1 December 2007 version of the Treatment Guidelines.

CHICAGO (Reuters *don't post a comment that Reuter's doesn't like, you will be banned) - At an ill-fated press conference in 1984, U.S. Health and Human Services Secretary Margaret Heckler boldly predicted an effective AIDS vaccine would be available within just two years.

But a string of failed attempts - punctuated by a 2007 trial in which a Merck vaccine appeared to make people more vulnerable to infection, not less - cast a shadow over AIDS vaccine research that has taken years to dispel.

Reason contributor Terry Michael investigates a military trial in Ft. Bragg, North Carolina that ended with the acquittal of an Army sergeant of charges that he didn't inform sexual partners of his positive HIV status. 

Expert witnesses raised doubts about the general validity of HIV tests during the May aggravated assault trial of the NCO referred to by supporters (Michael provides his full name) discreetly as "Sgt. TD." It also seems the prosecution either didn't mount or wasn't allowed to mount a strong attack: 

An 8-year Army veteran, Dixon spent 247 days in pre-trial custody after charges brought in 2011, when he was arrested after a former girlfriend accused him of assault and battery, for throwing a plastic bottle at her during an argument. Judge Batdorf found Dixon guilty of that physical assault charge, unrelated to HIV status disclosure, and sentenced him to 120 days (waived for time he had already served.). The arrest resulted in Dixon’s “status” later being revealed, to other women identified as former sexual partners. There was no testimony in the trial from any of the women disputing Dixon’s claim that he used condoms.

There also was no testimony from any of the women that they had contracted HIV from Sgt. Dixon. The defense introduced into evidence a1997 scientific paper by Dr. Nancy Padian from the Univ. of California-San Francisco, who studied the potential for transmission of HIV in 176 “sero-discordant” heterosexual couples, where one partner was HIV-positive and the other HIV-negative, and not one of the subjects ever contracted HIV through sex.

Facebook group Movement Against the HIV & AIDS Theory set up in Malaysia

A dangerous theory that denies the connection between HIV and AIDS is being spread in Malaysia.

A Facebook group called Gerakan Bantah Teori HIV-AIDS Malaysia (meaning Movement Against the HIV-AIDS Theory Malaysia) was started two months ago and has 146 members.

Malaysian human rights activist Pang Khee Teik was alerted to the group when he was asked to be a member.

‘THIS DANGEROUS MOVEMENT has come to Malaysia,’ Pang said. ‘There is very shoddy science behind this movement, they use very weak populist logic to persuade people that HIV does not cause AIDS. This sometimes results in causing people not to get tested for HIV and also result in people with HIV not taking medication for HIV. This is a DANGEROUS movement.’

The Facebook group post messages such as ‘HIV testing is dangerous to your health’, ‘Life-long Anti-retroviral/cocktail therapy = Life-long profit for Pharmaceutical Industry’ and ‘HIV is NOT a Death Sentence. Take back YOUR LIFE. Start Questioning!'

As blood donations decline, U.S. ban on gay donors is examined

The American Red Cross says power outages created by recent storms in the East and Midwest cut blood donations, which were already low this summer. In June there was a nationwide shortfall, with donations down more than 10% across the country.

"We are asking people to please call 1-800-RED-CROSS or visit us at redcrossblood.org to find a way to donate if they can," said Stephanie Millian, Red Cross director of biomedical communications. "We need people's help."

One group that would like to help, but legally can't, may be moving one step closer to eligibility. Since the 1980s, when the AIDS epidemic decimated their community, gay men -- or MSMs (men who have sex with men) as they are called by federal agencies -- have not been allowed to donate blood. In June, a group of 64 U.S. legislators led by Rep. Mike Quigley, D-Illinois, and Sen. John Kerry, D-Massachusetts, sent a letter to the Department of Health and Human Services encouraging it to move forward with a study that may lead to the end of the decades-old ban.

"We remain concerned that a blanket deferral of MSM for any length of time both perpetuates the unwarranted discrimination against the bisexual and gay community and prevents healthy men from donating blood without a definitive finding of added benefit to the safety of the blood supply," the letter said.

Judge rules prosecution must show that HIV is dangerous

Syracuse, NY - A Syracuse man accused of infecting a consensual sexual partner with HIV cannot be prosecuted on a felony reckless endangerment charge, a local judge ruled today.

In a 12-page decision, state Supreme Court Justice John Brunetti said the prosecution did not have sufficient evidence that Terrance Williams' conduct created a grave and unjustifiable risk of death to his sexual partner.

To pursue such a prosecution, the District Attorney's Office would need to present expert testimony as to the prognosis for a person who contracted HIV now, Brunetti concluded.

Should hiding HIV status always be a crime?

Canadians living with HIV should not face jail time for keeping their medical condition from sexual partners if the risk of transmission is low or if they use condoms while having sex, civil liberties advocates say.

Criminal prosecution should be reserved for those who intentionally infect others, they add while asking the Supreme Court of Canada to define the meaning of “significant risk of harm” and compel its use as a standard in determining whether to prosecute people (using Criminal Code provisions such as aggravated sexual assault) who fail to disclose their HIV-positive status to sexual partners.

When an AIDS doctor declares that a patient with a CD4 count is “severely immunesuppressed”

he is making a prediction based on the CD4 count with near certainty. When

a doctor proclaims that an HIV positive person’s CD4 count of 200 or 350 or 500 shows

that it is “time to start drugs” they are also making a prediction on the basis of a CD4

count, a prediction with implied certainty. Perhaps, if pressed, the doctor might admit that

there are some people with low CD4 counts who are not sick, but the basic message is

that CD4 counts have been shown, scientifically, to be highly accurate indicators of your

stage of “progression to AIDS” – from asymptomatic to pre-AIDS (“AIDS-related

complex”) to full-blown AIDS and then death.

But, what is the evidence that CD4 counts are associated with stage of immune

suppression? And, how accurate would a prediction that a certain CD4 count indicates

that a person is at a particular stage of HIV or AIDS be?

On Monday, the Department of Justice announced that drug company GlaxoSmithKline agreed to pay a $3 billion fine, the largest health care fraud fine in the history of the United States. This fine is just the latest in a string of drug company penalties for improper promotion of drugs for “off-label,” or unapproved, uses. Here we take a look at six recent multi-million dollar fines that drug companies have agreed to pay for inappropriately, and in some cases illegally, promoting prescription drugs.

Eli Lilly

JAN 2009

Eli Lilly was fined $1.42 billion to resolve a government investigation into the off-label promotion of the anti-psychotic Zyprexa. Zyprexa had been approved for the treatment of certain psychotic disorders, but Lilly admitted to promoting the drug in elderly populations to treat dementia. The government also alleged that Lilly targeted primary care physicians to promote Zyprexa for unapproved uses and “trained its sales force to disregard the law.”


Pfizer

SEPT 2009

Pfizer was fined $2.3 billion, then the largest health care fraud settlement and the largest criminal fine ever imposed in the United States. Pfizer pled guilty to misbranding the painkiller Bextra with "the intent to defraud or mislead", promoting the drug to treat acute pain at dosages the FDA had previously deemed dangerously high. Bextra was pulled from the market in 2005 due to safety concerns. The government alleged that Pfizer also promoted three other drugs illegally: the anti-psychotic Geodon, an antibiotic Zyvox, and the anti-epileptic drug Lyrica.

AstraZeneca

APRIL 2010

AstraZeneca was fined $520 million to resolve allegations that it illegally promoted the anti-psychotic drug Seroquel. The drug was approved for treating schizophrenia and later for bipolar mania, but the government alleged that AstraZeneca promoted Seroquel for a variety of unapproved uses, such as aggression, sleeplessness, anxiety, and depression. AstraZeneca denied the charges but agreed to pay the fine to end the investigation.

Merck

NOV 2011

Merck agreed to pay a fine of $950 million related to the illegal promotion of the painkiller Vioxx, which was withdrawn from the market in 2004 after studies found the drug increased the risk of heart attacks. The company pled guilty to having promoted Vioxx as a treatment for rheumatoid arthritis before it had been approved for that use. The settlement also resolved allegations that Merck made false or misleading statements about the drug's heart safety to increase sales.

Abbott

MAY 2012

Abbott was fined $1.5 billion in connection to the illegal promotion of the anti-psychotic drug Depakote. Abbott admitted to having trained a special sales force to target nursing homes, marketing the drug for the control of aggression and agitation in elderly dementia patients. Depakote had never been approved for that purpose, and Abbott lacked evidence that the drug was safe or effective for those uses. The company also admitted to marketing Depakote to treat schizophrenia, even though no study had found it effective for that purpose.

GlaxoSmithKline

JULY 2012

GlaxoSmith Kline agreed to pay a fine of $3 billion to resolve civil and criminal liabilities regarding its promotion of drugs, as well as its failure to report safety data. This is the largest health care fraud settlement in the United States to date. The company pled guilty to misbranding the drug Paxil for treating depression in patients under 18, even though the drug had never been approved for that age group. GlaxoSmithKline also pled guilty to failing to disclose safety information about the diabetes drug Avandia to the FDA.

All nonstandard views are included here--even the alarmist and hateful views of those who espouse AIDS as God's wrath against a sinful people or believe that one can get AIDS by simply being in the same room with someone who has the disease. But these are only a small part of this good text. Also covered here are alternative treatments, unofficial research, and possible causes and cofactors. Coding the individual works by topic (i.e., alarmist, macrobiotic, ecological) would have been useful, but perhaps there would have been too much overlap. Recommended for academic, public, and medical libraries.

Four-in-one Aids drug gets green light

Paris - An experimental once-daily pill that combines four drugs to fight HIV is as safe and effective as commonly-prescribed treatments against the Aids virus, researchers reported in The Lancet on Friday.

Doctors tested the new drug, called Quad, for the third and final phase in which new pharmaceutical products are vetted for safety and effectiveness.

Publication in the British journal follows a recommendation in May by a US Food and Drug Administration (FDA) advisory panel to approve Quad for previously untreated adults infected with HIV-1. A final decision is expected by August.

The first trial entailed testing Quad against a three-in-one pill, Atripla, which since 2006 has been a standard treatment for the human immunodeficiency virus (HIV).

• “AIDS Truth’s approach is to destroy (by public exposure) the “leadership” of the AIDS denialist movement and thereby prevent them from causing the deaths of people who for various reasons are prone to believing the lies the denialists peddle for political reasons, including the profit motive.”

First, there is no “Aids denialist movement.” This is a term Moore has invented to describe those have pointed to the massive, blood-soaked failures of the standard Aids belief system, and pleaded for a new plan of attack on the many problems that “Aids” represents and stands in for.

Second, the profit motive belongs, solely, to the mainstream. Nobody is getting rich by asking GlaxoSmithKline, Abbott, Pfizer, Boehringer Ingelheim, or Bristol-Myers-Squibb to stop poisoning poor, Black children with their very profitable, internationally distributed and hawked drugs.
