Judge rules 2nd time: prosecutors don't have sufficient evidence that unprotected sex with someone with HIV creates a "grave risk" of death

Syracuse, NY - For the second time in as many months a judge has ruled Onondaga County prosecutors don't have sufficient evidence that unprotected sex with someone with HIV creates a "grave risk" of death.
In a 13-page decision made public today, state Supreme Court Justice John Brunetti ruled the District Attorney's Office did not have evidence to support a felony reckless endangerment prosecution against Terrance Williams for knowing he had HIV and having unprotected sex with another man.

Instead, the judge ordered the felony charge of first-degree reckless endangerment reduced to a misdemeanor count of second-degree reckless endangerment. The judge also ruled there was sufficient evidence to support a prosecution for a misdemeanor charge of third-degree assault.
Williams, 23, has been indicted twice on felony reckless endangerment charges based on allegations he created a grave risk of death to another man from July to October 2010 by engaging in consensual sex without revealing he had been diagnosed as HIV positive in December 2009.

Lawsuit over false HIV diagnosis settled in DC as trial neared; terms not disclosed


WASHINGTON — A District of Columbia health clinic specializing in HIV and AIDS has settled a lawsuit that accused a staff member of mistakenly telling a patient he was HIV-positive.
The Washington Post says terms of Terry Hedgepeth’s settlement with the Whitman-Walker Clinic weren’t disclosed, but the agreement was reached as both sides prepared for trial. .
Hedgepeth brought a $20 million lawsuit in 2005, five years after a clinic worker mistakenly wrote in his files that he had tested positive for HIV.
The test was negative, but Hedgepeth didn’t know that until he decided to seek alternative treatment in 2005.
His lawyer says the misdiagnosis caused post-traumatic stress.
A D.C. appeals court recently ruled that patients given incorrect information from their doctors about a life-threatening illness can sue for emotional distress.

Everyone Reacts Positive on the ELISA Tests for HIV

For the last 6 years I have been working at a laboratory of clinical immunology in one of the most prestigious University Hospitals in the City of New York. Here I have had the opportunity to personally run and get to know in detail the current tests used for the diagnosis of HIV status, namely, the ELISA, Western blot and Viral Load tests.



1. Diluting the serum for the ELISA testThe ELISA test is a test for antibodies against what is supposed to be the Human Immunodeficiency Virus or HIV. To run this test, an individual’s serum has to be diluted to a ratio of 1:400 with a special specimen diluent. According to the test kit manufacturer this diluent contains "0.1% triton X-100, Bovine and Goat Sera (minimum concentration of 5%) and Human T-Lymphocyte Lysate (minimum titer 1:7500). Preservative: 0.1% Sodium Azide" (1).

This extraordinarily high dilution of the person’s serum [400 times] took me by surprise. Most serologic tests that look for the presence of antibodies against germs uses neat serum [undiluted]. For example, the tests that look for antibodies to hepatitis A and B viruses, rubella virus, syphilis, hystoplasma and cryptococus, to mention a few of them, use straight serum [undiluted]. However, to try to prevent false positive reactions some serologic tests use diluted serum; for example this is the case with tests that look for antibodies to measles, varicella and mumps viruses which use a dilution of 1:16, to cytomegalovirus [CMV] 1:20 and to Epstein-Barr Virus [EBV] 1:10.

The obvious questions are: What makes HIV so unique that the test serum needs to be diluted 400 times? And what would happen if the individual’s serum is not diluted ?

Sex and the Soul – the Origins of the HIV

If HIV is a hoax (if HIV tests do not test for any particular thing – and they don’t, and you can look that up), and “infection” is based on this non-test – then HIV tests don’t have any clinical meaning.
We’re also told that you can “have” “HIV” and not know it. But, have you ever had an STD and not known it?? A sexually-transmitted yeast infection, herpetic infection, or any other sore or pimple in your groin – and “not known it?” (How did they sell us this garbage?)
And that’s their line – the tests don’t test for anything, and you’ll never know, unless you trust the test. It’s a very religious run-around.
But, we assign them great value. Why?

Denying AIDS. Seth Kalichman in review by OMSJ


I meet Seth Kalichman’s "assistant" Lisa at a screening of “HOUSE OF NUMBERS”. I challenged her to tell me what if anything that was contained in the film was in her view made up, out of context, or unknown to her. Her reply basicly was that she didn't know about the Bangui definition. “Great” I said. Let's discard the rest of the film for just a moment and agree that the Bangui Definition is worth having a broader and new dialog. "NO"..why no if it's something she knew nothing about? I was talking to the bubble. She agreed to have this conversation if on the “HOUSE OF NUMBERS” website there could be a link to promoted Seth book “Denying Aids”. I agreed if Seth would promote the film “HOUSE OF NUMBERS” on Seth’s Denying AIDS website ". She said “i'll talk to Seth” and get back to you. 2 years later i'm still waiting for that call.

In 2008, John P. Moore Ph.D. and Seth Kalichman Ph.D. joined an unknown blogger who posted this cynical obituary after the death of Christine Maggiore, who died from complications related to an adverse drug reaction.  Before her body cooled, Kalichman, Moore and a who’s who of pharmaceutically-funded activists parroted false claims that Maggiore’s death was adeserving end of a prominent “AIDS denialist.”  An Internet search will locate thousands of messages, news stories and reports that assert (among other things) that Maggiore and her baby would be alive today, “if only she taken life-saving AIDS medications.” To Kalichman, the actual cause of her death wasn’t important.

HIV Criminalization Compounded by Confusion Over Validity of HIV Test

Hillary Clinton, who has personally known people who have died from AIDS—she spoke at her friend Bob Hattoy’s memorial, for instance—told the International AIDS Conference on Monday: “If we’re going to beat AIDS, we can’t afford to avoid sensitive conversations, and we can’t afford not to reach the people who are at the highest risk.” Getting tested to know one’s status to get help and not pass on the disease has been a health care mantra for years. But some HIV/AIDS activists are now prompting “sensitive conversations” about the quietly increasing criminalization of HIV. 



POZ founder Sean Strub (“Take the Test and Risk Arrest?”)  and longtime HIV/AIDS journalist Todd Heywood, in particular, have been sounding the alarm. But now freelance journalist Terry Michael—a self-described “independent Washington journalist, who directs the Washington Center for Politics & Journalism, and who has covered the HIV-AIDS story at his personal web site,where he raises questions about HIV-AIDS theory”—raises some even more troubling questions about how the validity of HIV tests themselves are being questioned in courtrooms. In early July, Michael emailed me that he had covered two cases of “HIV Panic” in military courts. Just six weeks after an Army judge at Ft. Bragg, North Carolina, acquitted a heterosexual soldier in a so-called “HIV panic” case, another military judge at Ft. Belvoir in Virginia found a gay Army officer guilty on all counts for not revealing his HIV status and engaging in unprotected sex.

(CNN) -- The nightmare Nick Rhoades has been living the past four years began after a one-time sexual encounter with another Iowa man, Adam Plendl.
It was June 2008. The 34-year-old Rhoades, who is HIV positive, says he was on antiretroviral medications. His viral load -- the amount of virus in his blood -- at the time was undetectable and he says he wore a condom. But Plendl contacted the police because Rhoades did not disclose his HIV status.

Tennessee Man Loses Wife, Job After False HIV-Positive Test

GOODLETTSVILLE, Tenn. - A 47-year-old father of two said a false positive HIV test cost him his family and his job.  Now he's proven he's healthy, but says he still can't clear his name.
"I was devastated.  I thought it was the end of the world. I thought I was going to die," said Sean Smith.





Earlier this year Smith went to give plasma in Goodlettsville, but after the staff ran his name through a data base they turned him away.
"They told me I was HIV positive and they couldn't accept by blood," said Smith.  He was stunned.  Smith lived with the secret for months before telling his wife and that did not go well.
"She accused me of having an affair," said Smith.

The stress ended his marriage and cost Smith his job.  He figured the diagnosis came from a prior blood test, but that he was never notified.  Confused and scared he believed it.  But -- at his daughter's urging -- Smith had his doctor run an HIV test and it came back negative.

HIV-negative Zim women test positive after drug trials


About 127 Zimbabwean women who were HIV negative are feared to be now HIV positive after they participated in trials that were aimed at testing a set of drugs that medical experts thought could reduce the risk of infection.
Tenofovir, a key drug used in the study, has since been dropped after it failed to shield participants from contracting the virus.
Vaginal and Oral Interventions to Control the Epidemic (VOICE) project director Dr Nyaradzo Mgodi told The Sunday Mail last Friday that the women were part of a group that was always at risk of infection.
She said the project co-ordinators were still working to establish the exact number of the infected. She said participants who tested positive will receive HIV counselling, contraceptives and other medical support services. The participants are predominantly sexually active married or single women who live in communities with a high HIV prevalence
“The decision to discontinue the use of the Tenofovir tablet in VOICE came after the drugs were found to be ineffective in preventing HIV contraction among the women enrolled for the trials,”

AIDS Conference, protestors staged a “die-in” against Gilead Sciences

During the International AIDS Conference last week, protestors staged a “die-in” against Gilead Sciences—manufacturer of the HIV/AIDS medication Truvada—holding signs stating, Truvada Pricing is Murder, and_ Gilead: Greed Destroys Access to Care_, among many others. The protest was a very loud and very visible criticism of the pharmaceutical giant, particularly the difference that Truvada costs overseas and in the U.S.—$500 versus $11,000 respectively—as well the luxurious compensation of its CEO, John C. Martin.
This protest demonstrates two very important things. One, that AIDS activism is still very much alive, much to the fear of some; and two, that the InternationalAIDS Conference, its attendees, and its sponsors, have a very complicated relationship.

How food and nutrition can help turn the tide on HIV

For Tankiso, an HIV-positive mother living in rural Lesotho, food has made all the difference.

“When I first learned of my HIV status, I also learned about the services available at my local health clinic, including WFP food assistance,” said Tankiso. “Since 2011, I’ve followed my medical treatment and visited the clinic regularly, where I also benefit from WFP’s nutrition support.”
Scientific evidence and our own experience shows that nutrition activities for people living with HIV—including nutritional assessments, counselling, education and fortified food for malnourished patients—has significant impacts on the health of patients, on their ability to stay on treatment and on the effectiveness of treatment.

Hair samples from infants show exposure to anti-HIV drugs in the womb and during breast-feeding

Researchers from the University of California, San Francisco (UCSF) and Makerere University in Uganda have used hair and blood samples from three-month old infants born to HIV-positive mothers to measure the uninfected babies' exposure—both in the womb and from breast-feeding—to antiretroviral medications their mothers were taking. The results, they said, are surprising
.

"We found high levels of exposure to three antiretroviral medications in the hair samples of HIV uninfected infants at twelve weeks of life," said study senior author, Monica Gandhi, MD, MPH, associate professor of medicine at the UCSF Division of HIV/AIDS at San Francisco General Hospital and Trauma Center (SFGH). "From looking at plasma level data at the same time point, we believe that transfer of two of the medicines from mother to baby occurs exclusively in the womb and transfer of the third medication occurs both in the womb and through breastfeeding."

Since “HIV” doesn’t cause “AIDS”, why were gay men the first victims of AIDS, and why do they so often test “HIV-positive”?

I started this blog nearly 5 years ago, with the immediate aim of applying to continuing “news” about HIV/AIDS the insights I had gained from collating HIV-test results, namely, that what these tests detect or measure is not an infectious entity, nor is it correlated with the published numbers for “AIDS” (The Origin, Persistence and Failings of HIV/AIDS Theory).
Comments from various quarters helped me to learn much more, especially about why gay men have been so much involved; and I was prompted to further analyses of official data, which revealed yet more flaws in HIV/AIDS theory:
  • Many confirmations have appeared from different countries and circumstances of the epidemiological regularities I had found in the largely USA data analyzed in my book, perhaps most strikingly the racial disparities and perhaps most mysteriously the correlation with population density.
  • I’ve noted a fine array of absurdities: pregnant women more likely to become “HIV-positive” than non-pregnant women; breast-feeding protective against becoming “HIV-positive” despite being a supposed avenue for transmission of HIV; mainstream activists urging that drug addicts be given fresh clean needles so that they could more safely kill themselves through drug abuse; assertions that HIV is transmitted in different ways in different parts of the world; and more.
As time has passed, fewer and fewer items appeared in the media that were both new and noteworthy and therefore worth blogging about. Microbicide and vaccine trials continue to fail — what more can be said about that except that it confirms over and over again the vacuity of HIV/AIDS theory? Official agencies continue to trumpet the danger of HIV/AIDS even as fewer and fewer people are affected by it — how often is that worth mentioning? Mainstream sources continue to applaud the lifesaving benefits of antiretroviral drugs even as the official Treatment Guidelines and primary literature continue to report the dangerous toxicity of antiretroviral treatment and the continual production of new drugs intended to be less toxic — how often is that worth writing about? And what more can be said about the continuing mis-direction by mainstream sources of labeling as “HIV-associated” ailments that are actually owing to antiretroviral drugs: lipodystrophy, kidney failure, heart failure, and much more (in addition to the re-labeling in Africa of well known diseases as “AIDS”: tuberculosis, malaria, and more).
So after a few years of blogging here, media coverage of HIV/AIDS has become for me déjà vu all over again

“On the Front Lines of the AIDS Pandemic” by Harry Haverkos

Harry Haverkos is an enigma for HIV and AIDS rethinkers. A product of the US medical establishment he pursued the theory that one of the two major AIDS indicator disease known as Kaposi’s Sarcoma [KS] (the other was Pneumocystis carinii Pneumonia, or PCP) was caused by the practice of many gay men to inhale amyl nitrite ‘Poppers’. Yet, even so, Haverkos always gave allegiance to the infectious HIV=AIDS=Death dogma. His new book, “On the Front Lines of the AIDS Pandemic” describes just how deeply he was embedded within the AIDS establishment even before the AIDS era officially began, in the years 1980 to 1984, while at the CDC (US Centers for Disease Control).
